A Key Milestone for Trade and Service Marks in Tanzania!
From March 11, 2024, Tanzania through the Business Registrations and Licensing Agency (BRELA) joined and accepted the terms from the harmonized database of the TM Class System.
The TM Class System is a globally recognized system that categorizes goods and services into 45 different classes also known as the NICE Classes. This system is an online system developed by the European Union Intellectual Property Office (EUIPO) the aim of which is to help and simplify the submission of applications for Trade and Service Marks to the countries of the European Union and other members states.
Through BRELA joining the TM Class System the stakeholders will have various benefits including:
- A simplified and organized trademark search, which is an important step that is done to ensure that the mark to be registered is not already in use by another business or company. The TM Class offers users the opportunity to search and classify their trademarks under the NICE classification.
- Global recognition: The TM Class System is globally recognized making it easier for businesses to register and protect trademarks internationally. Further, the NICE Classification system ensures compatibility with the international standards of trademark classification.
- Effective legal protection: The trademark class system makes it easier for trademark owners and law enforcement to effectively enforce their rights when goods or services that infringe on the trademark belong to the same class or a related class. A uniform classification of goods makes it easier for legal authorities and trademark owners to identify elements of trademark infringement effectively.
